1. Scope

1.1 These General Terms and Conditions apply to all orders placed by customers via the online store of Langatun Distillery AG, Eyhalde 10, 4912 Aarwangen [UID no. ].

1.2 With the confirmed order, these General Terms and Conditions shall be deemed accepted by the Purchaser.

2. Offer and conclusion of contract

2.1 The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to order.

2.2 By clicking the button (Order), the customer places a binding order for all products listed on the order page.

2.3 Immediately after receipt of the order, Langatun Distillery AG shall confirm the order by e-mail. The purchase contract is concluded immediately in the case of non-physical goods, in the case of physical goods by their delivery.

3. Prices and shipping costs

3.1 The prices stated on the product page are inclusive of statutory VAT and exclusive of other price components (postage, packaging) and are in Swiss francs (CHF). The exact shipping costs are displayed to the customer in the order process.

3.2 Further taxes and costs do not apply (with the exception of customs duties for deliveries abroad).

3.3 The Provider reserves the right to change the prices at any time. The prices published on the website on the date of the order shall apply to the Customers.

4. Delivery conditions

4.1 Physical goods shall only be delivered within Switzerland.

4.2 The delivery time is 1 to 2 business days for Switzerland, unless otherwise stated in the offer. If a longer delivery time is necessary, the customer will be informed after this time at the latest. If no information is provided, the customer is entitled to waive the delivery.

4.3 If not all ordered products are in stock, Langatun Distillery AG is entitled to make partial deliveries.

4.4 If the delivery of the goods fails due to the fault of the customer despite three delivery attempts, Langatun Distillery AG may withdraw from the contract. Any payments made will be refunded immediately.

5. Terms of payment

5.1 Payment for customers in Switzerland can be made either by credit card, cash in advance or via Paypal.

5.2 In the case of payment by Paypal, the debit of the account of the customer takes place at the time of the order.

5.3 Offsetting with counterclaims of the customer that are not recognized or not legally established is excluded.

5.4 The customer may only exercise a right of retention insofar as the claims are based on the same contractual relationship.

6. Retention of title

The goods shall remain the property of Langatun Distillery AG until payment has been made in full. Before transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without the consent of Langatun Distillery AG.

7. Right of withdrawal

7.1 Consumers have the right to revoke the contractual declaration within 14 days after receipt of the goods. The revocation must be sent to Langatun Distillery AG in writing by e-mail, fax or letter. For the observance of the deadline, the date of dispatch of the revocation is decisive. A statement of reasons for the revocation is not required. The declaration of revocation is to be sent to:

7.2 The exercise of the right of withdrawal leads to the transformation of the purchase contract into a return relationship, according to which the services received under the purchase contract must be refunded.  The Consumer must return the received goods with the original packaging to Langatun Distillery Ltd. within 14 days after declaring the revocation. The costs of the return shipment shall be borne by the consumer.

7.3 After receipt of the goods, the purchase price, if already paid, will be refunded to the consumer immediately. A deduction from the purchase price to be refunded for possible damage or excessive wear and tear of the goods is reserved. No deduction will be made if the loss in value is due to handling of the goods that is necessary to determine the nature, condition and functionality of the goods. Langatun Distillery AG may refuse repayment until the goods have been returned or until the consumer has provided proof that he has returned the goods, whichever is the earlier.

7.4 The right of withdrawal is excluded for the following items:

• Individual company solutions, which are clearly tailored to the personal needs of the customer

• Digital content, the execution of which occurs simultaneously with the order and which is not delivered on tangible data carriers

• Services that have already been fully performed or whose performance has already begun

8. Warranty and liability

8.1 Langatun Distillery AG warrants that the goods comply with the warranted characteristics, do not have any defects impairing their value or suitability for the intended use, and comply with the prescribed performance and specifications. Langatun Distillery AG reserves the right to remedy an existing defect or to supply a defect-free item in the sense of a repair or replacement delivery.

8.2 The Buyer shall inspect the delivered goods as soon as possible and report any defects immediately. You can find our responsible customer service at: sales@langatun.ch.

8.3 If rectification or subsequent delivery fail, the customer shall be entitled to withdraw from the contract. This shall not apply to insignificant defects. A right of the customer to a reduction is excluded.

9. passwords / secrecy

In the case of products made available online, the Customer undertakes to treat the access data provided for the system and the passwords set up for this purpose with the utmost confidentiality and care. Langatun Distillery AG reserves the right to terminate the right of use immediately if multiple use of access data of a single authorized user is discovered.

10 Copyright / Copyright

The content and structure of the products published by Langatun Distillery AG and the entire Internet offering are protected by copyright. The use of contributions and working aids for personal use by the customer is permitted, but complete or partial commercial distribution requires the express consent of Langatun Distillery AG.

11. Liability

Langatun Distillery AG excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes. Langatun Distillery AG assumes no responsibility for errors that do not lie within its sphere of responsibility, namely with operators of telecommunications services, the hosting provider or other third-party service providers.

12. Jurisdiction and applicable law

The contractual relations between the Customer and Langatun Distillery AG shall be governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980. The ordinary court in Zurich shall have jurisdiction over any disputes arising from these contractual relations.

13. Final provisions

If parts of these general terms and conditions should be invalid, this shall not affect the validity of the remaining provisions. Instead of the invalid provisions, the relevant statutory provisions shall apply mutatis mutandis.
